PRIVACY POLICY

PITBAY.COM LLP has a high regard for the protection of the privacy of Members using PITBAY.COM and has, accordingly, devised this Privacy Policy which forms part of the Rules.

1 Definitions:

The words, phrases and expressions used in PITBAY.COM LLP’s Privacy Policy (“the Privacy Policy”) shall have, unless expressly stated to the contrary, have the same meanings as set out in the Rules of Membership and for the Use of the Services of PITBAY.COM (“the Rules”)

Words used in the Privacy Policy importing the masculine gender shall include the feminine gender, words importing the single number shall include the plural and vice versa

2. Express consent

On Registration each Member agrees to expressly consent to PITBAY.COM LLP using and disclosing his Member’s Data as set out in the Privacy Policy. Any intending Member not prepared to accept the use and/or disclosure of his Member’s Data should not effect Registration.

3. Minors

Membership of PITBAY.COM is restricted to Members aged 18 or over. Minors must not submit any data to PITBAY.COM

4. Member’s Data

Member’s Data is collected for the purposes of enabling Members to use the Services and for no other purpose.

Whilst it is possible to browse PITBAY.COM without disclosing any Member’s Data, to use the Services it is necessary to disclose to PITBAY.COM LLP all necessary contact, identity, financial and other personal information as indicated when required by PITBAY.COM LLP, although some fields may be required and others optional. Each Member always has the option not to provide Member’s Data by not using particular features of the Services.

Where any payment is to be made to PITBAY.COM LLP, Members will be required to provide information such as credit card details. PITBAY.COM LLP may also use credit card details for verification of identities and/or addresses.

Each Member’s use of PITBAY.COM including information on buying, selling and bidding will be monitored and collected by PITBAY.COM LLP. PITBAY.COM LLP will also collect and monitor Member’s feedback on other Members.

5. PITBAY.COM LLP’s use of Member’s Data

PITBAY.COM LLP will use Member’s data it has collected to resolve disputes, provide Member’s support, troubleshoot problems and to enforce the Rules.

Each Member agrees that PITBAY.COM LLP may use Member’s Data for marketing and promotional purposes, analysing site usage, improving site content and layout and the provision of the Services.

6. PITBAY.COM LLP’s disclosure of Member’s Data

PITBAY.COM LLP will not sell or rent a Member’s Data without his specific consent.

PITBAY.COM LLP may provide non-identifiable personal information of all Members to advertisers and other third parties.

However, no personal information such as names, email addresses, postal addresses, passwords, credit card numbers and bank account numbers will be disclosed except where required by Statute, Regulation, Warrant, Court Order or similar lawful authority.

Each Member’s User Name will be displayed throughout PITBAY.COM and will become known to the public. All Members’ activities on PITBAY.COM will be identifiable to their User Names, including bids, Items purchased and sold, feedback ratings and postings. If a Member’s User Name is similar to his own name, then the latter will become identifiable on PITBAY.COM through the use of the Services.

PITBAY.COM LLP is unable to ensure Members that Member’s Data will never be disclosed in ways other than set out above, particularly in the cases of unlawful access or interception by third parties or by abuse by third parties to whom PITBAY.COM has been permitted to disclose Member’s Data. If any Member is concerned that such events may occur he should not use the Services.

7. Control of User Names and Passwords

Each Member is responsible for the use of his own User Name and Password, including those actions where Fees are charged. In the circumstances, PITBAY.COM strongly advises that Members should not disclose their Passwords to any third party. Any Member whose Password has been compromised for any reason should change his Password immediately.

8. Accessing, Reviewing and Amending Member’s Data

Members can update any part of their Member’s Data online by following the required procedures. Members must also update their Member’s Data where relevant personal information has changed or where it is inaccurate.

Any Member may, by notice, require PITBAY.COM LLP to deactivate their account and remove their Member’s Data from its active databases. However, PITBAY.COM LLP will retain deactivated Member’s Data on its files for several purposes including enforcing the Rules, dispute resolution and technical and legal constraints. Member’s Data will never be completely or permanently removed from PITBAY.COM LLP’s files.

9. Other users of Member’s Data

The Privacy Policy only relates to Member’s Data provided by Members to it and does not relate to ant Member’s Data provided by Members to each other or third parties. Members are advised to make full enquiries before disclosing Member’s Data to third parties.

10. Security

PITBAY.COM LLP will use all reasonable and necessary to safeguard the confidentially of all Member’s Data and acknowledges that it is must be protected against loss and/or unauthorised access. However, Members have to accept that absolute security cannot be guaranteed.

11. Changes

PITBAY.COM LLP reserves the right, from time to time, to amend the Privacy Policy by notice to Members. The amendments will come into effect 30 days the date of notice. Amendments will only be made in the light of regulatory requirements, and PITBAY.COM LLP’s data collection and disclosure practices.
